Legal notice
All transactions with and by Nick Buys Watches comply with Australian law.
We will not make or accept payments of $10,000 or more in physical currency (cash) or virtual assets. This applies even if a payment is split over several transactions that each fall under $10,000, as long as those transactions are linked or appear to be linked.
About these terms
This website is run by Nicholas Claudio Neroni, a sole trader, trading as Nick Buys Watches (ABN 67 857 986 503). In these terms, "we", "us" and "our" mean Nick Buys Watches, and "you" means the person using the site.
By using this website, you agree to these terms. If you do not agree, please do not use the site.
Using this website
This website is for private sellers in Australia who want an offer on a pre-owned luxury watch.
You must be at least the age of majority in your state or territory to use this site. Please use the site honestly and lawfully. Do not send false, misleading or harmful material, and do not try to interfere with the site or how it works.
The information on this site is general only. Please do not rely on it as the sole basis for a decision about selling a watch. We may change or remove content on the site at any time.
We may refuse to deal with anyone, at any time, for any lawful reason.
Prohibited uses
You must not use this site:
- for any unlawful purpose, or to ask others to carry out unlawful acts
- to break any law or regulation, or to infringe the intellectual property rights of us or anyone else
- to harass, abuse, insult, harm, defame or discriminate against anyone
- to give false or misleading information, or to impersonate someone else
- to upload or send viruses or any other malicious code
- to collect or track the personal information of others

- for any obscene or immoral purpose
- to interfere with or get around the security features of the site
We may end your access to the site if you break any of these rules.
Quotes and offers
When you send us details of a watch, you commit to nothing. You are under no obligation to sell, and we are under no obligation to buy.
Any offer we give you is an estimate. It is based on the details and photos you supply and on Australian market rates.
An offer is not binding on either side until we both agree, in writing or in person, and we have inspected the watch.
After inspecting the watch, we may change or withdraw our offer, for example if the watch differs from the details or photos you gave us. We may also decline to buy any watch.
What you send us
The details and photos you send us must be yours to send and must be accurate. You are responsible for what you send.
We may use the details and photos you send to assess your watch and prepare a quote. We may remove anything unlawful or offensive. Please do not send anyone else's personal information.
Seller's promises
When you sell a watch to us, you promise that:
- you are the owner of the watch, or you are legally entitled to sell it
- the watch is not stolen
- the watch is not subject to finance or a security interest, such as a loan secured against it
- the details and photos you gave us are true and not misleading
If any of these turn out to be untrue, we may cancel the purchase and take the steps the law allows.
Identification and records
We may ask to see and record your identification, for example a driver's licence, before we buy a watch. We may also keep records of the purchase as the law requires.
If you do not want to provide identification, we may decline to buy the watch.
Payment
We will agree with you how and when you are paid before any sale goes ahead.
Postage and meeting
We will agree with you whether the watch is posted or handed over in person, and who covers any postage or insurance, before any sale goes ahead.
Brands
Nick Buys Watches is independent. We are not affiliated with, endorsed by or sponsored by any watch brand named on this site. Brand names are used only to describe the watches we buy.
Third-party links and tools
This site may link to, or use, tools and websites run by other people. We do not control them and are not responsible for them, their content or how they work. Please read their terms before you use them.

Liability
We take reasonable care with this website, but we cannot promise it will always be available, uninterrupted or free of errors. The site is provided as it is and as available.
To the extent the law allows, we are not liable for any loss or damage, including indirect or consequential loss, that comes from using this website or relying on information on it.
Nothing in these terms excludes, restricts or changes any rights you have under the Australian Consumer Law or any other law that cannot be excluded.
Indemnity
To the extent the law allows, you agree to cover us for any loss, claim or cost, including reasonable legal fees, that comes from your breach of these terms or your breach of any law or the rights of another person.
Privacy
We handle your personal information as set out in our Privacy Policy. If you opt in to news and offers by email, you can unsubscribe at any time by replying to any email or emailing us.
Ending your access
We may end your access to this site at any time if we suspect you have broken these terms. Any promises you made and any amounts you owe before then continue after your access ends.
Severability, waiver and the whole agreement
If any part of these terms cannot be enforced, that part is removed and the rest still applies.
If we do not enforce a right under these terms straight away, we have not given it up.
These terms are the whole agreement between you and us about using this site. A term is not read against us just because we wrote it.
Changes
We may change these terms from time to time. The latest version will always be on our website, with the date it was last updated at the top. Please check it now and then. If you keep using the site after a change, you accept the updated terms.
